Welcome to Oh My Images! These Terms of Service ("Terms") govern your use of our AI image generation platform. By accessing or using Oh My Images, you agree to be bound by these Terms.
If you do not agree with any part of these Terms, you may not use our service.
**Important**: Please read these Terms carefully, along with our Privacy Policy, before using Oh My Images.
AI Wrapper Transparency & Model Attribution
Independent Branding
Oh My Images is an **independent platform** and is NOT affiliated with, endorsed by, or officially associated with any AI model providers, including:
- Google LLC
- OpenAI
- ByteDance Ltd.
- Any other AI technology companies
We do not represent, act on behalf of, or claim partnership with these companies. Oh My Images is independently operated by a solo developer based in China.
AI Models and Providers
Oh My Images provides access to the following third-party AI models through API integration:
**1. Nano Banana & Nano Banana Pro**
- **Developer**: Google LLC
- **Access**: Via ApiMart and Kie APIs

**2. GPT-4o Image**
- **Developer**: OpenAI
- **Access**: Via ApiMart API
- **Official Policy**: https://openai.com/policies/usage-policies
**3. Seedream 4.0 & Seedream 4.5**
- **Developer**: ByteDance Ltd. (Doubao/豆包)
- **Access**: Via ApiMart API
- **Official Policy**: https://www.doubao.com/terms
**Trademark Notice**: All model names, company names, and logos mentioned above are trademarks or registered trademarks of their respective owners. Oh My Images claims no ownership of these trademarks.
How Our Platform Works (AI Wrapper Architecture)
Oh My Images operates as an **AI Wrapper service**:
**What We Do**:
- Provide a user-friendly web interface to access multiple AI models
- Call third-party AI models through their official APIs
- Manage user credits and billing
- Store generated images temporarily (24 hours)
**What We Do NOT Do**:
- We do NOT develop, train, or own any AI models
- We do NOT modify, fine-tune, or customize the AI models
- We do NOT control the content generation algorithms
- We do NOT have access to the model's internal workings
**Analogy**: Think of us as a "remote control" for multiple AI services, making them easier to access in one place.
Responsibility Boundaries
**Oh My Images' Responsibilities**:
- Maintain platform uptime and performance
- Protect your account and payment information
- Provide customer support
- Handle billing and credits management
**Third-Party AI Providers' Responsibilities**:
- Model availability and response time
- Image generation quality
- Content filtering and safety measures
- Compliance with their own content policies
**Your Responsibilities**:
- Comply with both our Terms and the AI providers' policies
- Ensure your prompts and reference images do not violate copyright or contain prohibited content
- Use the service responsibly and legally
Content Policy References
Each AI model has its own content policy set by its provider. **You must comply with all applicable policies:**

**Note**: These policies may change without notice. It is your responsibility to stay informed.
Service Description
Oh My Images provides:
- **AI Image Generation**: Text-to-image and image-to-image generation using multiple AI models
- **Multiple Models**: Access to 5 different AI models (Nano Banana, Nano Banana Pro, GPT-4o, Seedream 4.0, Seedream 4.5)
- **Credits System**: Free and paid credits to use AI generation features
- **24-Hour Image Storage**: Generated and uploaded images are stored for 24 hours in Cloudflare R2
**What We Do NOT Provide**:
- Video generation or slideshow creation
- Custom AI model training
- Direct API access to AI models
- Permanent image storage (images are deleted after 24 hours)
Account Registration and Management
Eligibility
- You must be **at least 14 years old** to use Oh My Images
- If you are under 18, you must have parental or guardian consent
- You must provide accurate and complete information when creating an account
Account Creation
We currently support authentication via:
- **Google OAuth**: Sign in with your Google account
By signing up, you authorize us to access your Google account information (email, name, profile picture) as permitted by Google's OAuth policies.
Account Security
- You are responsible for maintaining the security of your account
- Do not share your account credentials with others
- Notify us immediately if you suspect unauthorized access: support@ohmyimages.com
- We are not liable for losses resulting from unauthorized use of your account
Account Termination
**By You**: You may request account deletion by contacting support@ohmyimages.com. We will process your request within 7 business days.
**By Us**: We reserve the right to suspend or terminate your account if you:
- Violate these Terms of Service
- Violate AI model providers' content policies
- Engage in illegal activities
- Abuse our service (e.g., excessive API requests, fraud)
- Fail to pay for services rendered
**Effect of Termination**: Upon termination, your access to the service will be revoked, and your data will be deleted as described in our Privacy Policy. Unused credits are non-refundable except as described in our Refund Policy.
Image Ownership and Usage Rights
You Own Your Generated Images
**Images you generate using Oh My Images belong to you.** You have full ownership and can use them for:
- Personal projects
- Commercial projects (e.g., marketing, products, websites)
- Social media posting
- Any legal purpose
**No Attribution Required**: You are not required to credit Oh My Images when using generated images.
Oh My Images' Rights
**We do NOT claim ownership** of your generated images.
**We do NOT use your images** for:
- Website showcases or marketing
- Training AI models
- Selling or licensing to third parties
**Exception**: If you explicitly grant us permission (e.g., by submitting to a community showcase contest), we may display your images with proper credit.
Reference Images (Image-to-Image)
When using image-to-image generation, **you are responsible for ensuring**:
- You own the copyright to reference images you upload, OR
- You have permission from the copyright holder to use them, OR
- Your use falls under fair use or other legal exceptions
**You agree to indemnify Oh My Images** against any claims arising from your unauthorized use of copyrighted images.
**We do not pre-screen reference images**, but we will respond to valid DMCA takedown requests.
Prohibited Content and Uses
**You may NOT use Oh My Images to generate or attempt to generate:**
**1. NSFW Content**
- Nudity, sexual content, or sexually suggestive imagery
- Adult or pornographic content
**Technical Note**: The AI models we use are configured by their providers to reject NSFW prompts. We do not provide any models specifically designed for adult content.
**2. Illegal Content**
- Child sexual abuse material (CSAM)
- Content that violates any applicable laws or regulations
- Content that facilitates illegal activities
**3. Violent or Harmful Content**
- Graphic violence, gore, or torture
- Content that promotes self-harm or suicide
- Content that incites violence against individuals or groups
**4. Hateful or Discriminatory Content**
- Hate speech targeting race, ethnicity, religion, gender, sexual orientation, disability, etc.
- Content that promotes discrimination or harassment
**5. Infringing Content**
- Images that violate copyright, trademark, or other intellectual property rights
- Deepfakes or manipulated images intended to deceive or harm individuals
**6. Spam or Malicious Content**
- Content intended to deceive, defraud, or harm others
- Phishing attempts or malware distribution
**Consequences**: Violation of these policies may result in immediate account suspension or termination without refund.
Credits System and Billing
Credit Types
- **Signup Credits**: 10 credits granted upon account creation (permanent)
- **Daily Login Credits**: 2 credits per day for logging in (expire after 48 hours)
- **Redemption Code Credits**: Credits from community codes (expire after 30 days)
- **Paid Credits**: Credits purchased through subscription plans (expire monthly)
- **Free Models**: Nano Banana and GPT-4o are free (0 credits) and do not consume credits
Credit Consumption
Credits are consumed when you generate images:
- **Nano Banana**: 0 credits (free)
- **Nano Banana Pro**: 4 credits per image
- **GPT-4o**: 0 credits (free)
- **Seedream 4.0**: 2 credits per image
- **Seedream 4.5**: 3 credits per image
**Deduction Timing**: Credits are deducted when you submit a generation request. If the generation fails due to system errors, credits will be refunded automatically.
Subscription Plans
**Free Plan**: $0/month
- Signup credits + daily login credits
- Access to all AI models
**Standard Plan**: $9.99/month or $99/year
- 300 monthly credits (expire at end of month)
- Daily login credits (2 credits/day, expire after 48h)
- All AI models
**Pro Plan**: $24.99/month or $249.90/year
- 1600 monthly credits (expire at end of month)
- Daily login credits (2 credits/day, expire after 48h)
- Priority support during high load
- All AI models
Refund Policy
**7-Day Refund Window**: You may request a refund within 7 days of purchase by contacting support@ohmyimages.com.
**Proportional Refund**: Refunds are calculated based on usage:
- Formula: `Refund Amount = Payment - (Credits Used / Total Credits) × Payment`
- Example: If you paid $9.99 for 300 credits and used 100 credits, refund = $9.99 - (100/300) × $9.99 = $6.66
**Non-Refundable Cases**:
- Requests made after 7 days of purchase
- Free credits (signup credits, daily login credits, redemption codes)
- Account termination due to Terms violation
**Processing Time**: Refunds are processed within 7-14 business days to your original payment method.
Content Moderation and User Responsibility
**No Pre-Screening**: We do not manually review prompts or reference images before generation. You are solely responsible for the content you create.
**AI Model Filtering**: The AI models we use have built-in content filters set by their providers (Google, OpenAI, ByteDance). These filters automatically reject prompts that violate their policies.
**Reporting Violations**: If you encounter content that violates these Terms, please report it:

**Investigation**: We will investigate reports within 48 hours and take appropriate action, which may include:
- Warning the user
- Deleting the content
- Suspending or terminating the user's account
**Liability**: You are legally responsible for the content you generate. We are not liable for user-generated content.
Service Availability and Disclaimers
No Guarantee of Availability
We strive to provide reliable service, but **we do not guarantee**:
- 100% uptime or availability
- Uninterrupted or error-free operation
- That AI model providers will always be available
**Service may be interrupted due to**:
- Cloudflare Workers outages
- Third-party API provider downtime (ApiMart, Kie)
- Scheduled maintenance
- Technical issues beyond our control
No Guarantee of Quality
**We do not guarantee**:
- Image generation quality or accuracy
- That generated images will match your expectations
- That the AI will interpret your prompts correctly
**AI Limitations**: AI models are probabilistic systems and may produce unexpected or low-quality results. This is a limitation of the technology, not our platform.
Limited Control Over Generated Content
**We cannot fully control** what AI models generate because:
- We do not develop or train the models
- AI models may sometimes bypass content filters
- Models may generate unintended or inappropriate content
**If you encounter problematic AI output**, please report it to us and the respective AI provider.
Limitation of Liability
**TO THE MAXIMUM EXTENT PERMITTED BY LAW:**
**Oh My Images shall not be liable for**:
- Indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenue, data, or goodwill
- Service interruptions or unavailability
- Errors or inaccuracies in generated content
- Third-party actions (AI providers, payment processors, etc.)
- User-generated content or copyright violations by users
**Maximum Liability**: Our total liability to you for any claims arising from these Terms or your use of Oh My Images shall not exceed the amount you paid us in the 12 months preceding the claim, or $100 USD, whichever is less.
Indemnification
You agree to **indemnify, defend, and hold harmless** Oh My Images, its operator, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising from:
- Your violation of these Terms
- Your violation of any law or third-party rights
- Your use of reference images without proper authorization
- Content you generate using our platform
- Your violation of AI model providers' terms and policies
Governing Law and Dispute Resolution
**Governing Law**: These Terms are governed by the laws of the **People's Republic of China**, without regard to conflict of law principles.
**Service Hosting**: While Oh My Images is operated from China, our service is hosted on Cloudflare's global network, which may process your data in multiple jurisdictions.
**Dispute Resolution**:
1. **Informal Resolution**: We encourage you to contact us first at support@ohmyimages.com to resolve any disputes informally.
2. **Negotiation**: If informal resolution fails, both parties agree to negotiate in good faith for 30 days.
3. **Arbitration/Litigation**: If negotiation fails, disputes shall be resolved through arbitration or litigation in accordance with Chinese law.
**EU/GDPR Compliance**: If you are located in the European Union, you may have additional rights under GDPR. Please contact us to exercise these rights.
Changes to These Terms
We may update these Terms from time to time. When we make significant changes:
- We will update the "Last Updated" date at the top of this page
- We may notify you via email or through a prominent notice on our website
- Continued use of our service after changes constitutes acceptance of the updated Terms
**Your Rights**: If you do not agree with the updated Terms, you may discontinue using our service and request account deletion.
Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Oh My Images regarding your use of the service.
